​Consultation: Renewal of class exemption for same class offers ASX/NZX-quoted financial products​

After considering submissions in relation to our review of the Financial Markets Conduct (Same Class Offers ASX/NZX-Quoted Financial Products) Exemption Notice 2018, we have decided to continue the relief for a further five years. This will provide continued relief from Parts 3 and 4 of the FMC Act to ASX-listed issuers with a secondary listing on the NZX who are offering financial products of the same class as ASX-quoted financial products. The current notice will be revoked on the close of 16 December 2023, and we intend to finalise a new notice to give effect to this decision before the current exemption expires.

We are reviewing whether to renew an existing class exemption notice applying to ASX-listed issuers with a secondary listing on the NZX for a further five years.  

The exemption facilitates offers of financial products of the same class as ASX-quoted financial products on an equivalent basis to the same class exclusion in Schedule 1 of the Financial Markets Conduct Act 2013.
